Warranty

 

ARMSTRONG MARINE, INC. NON-TRANSFERABLE LIMITED WARRANTY

The following Limited Warranty applies to all Armstrong Marine, Inc. vessels beginning with model year 2003.

WHAT IS COVERED

Limited Structural Hull Warranty For Non-Commercial Vessels: Armstrong Marine, Inc. warrants to the original non-commercial use purchaser for a period of ten (10) years from the date of purchase, to repair or replace, at its sole option, damage to the aluminum hull if it is found to be structurally defective in material or workmanship. For purpose of this Limited Warranty, the date of purchase is defined as the date of completion of the vessel. For purpose of this Limited Warranty, the hull is defined, as a single welded unit comprised of outer hull, transom, stringers and floor.

Limited Structural Hull Warranty For Commercial Vessels: Armstrong Marine, Inc. warrants to the original commercial use purchaser for a period of one (1) year from the date of purchase, to repair or replace, at its sole option, damage to the aluminum hull if it is found to be structurally defective in material or workmanship. For purpose of this Limited Warranty, commercial use is defined as use of vessel for business, government, education, research, taxi services, sightseeing, transport, diving, charter, search and rescue, fire, rental or any other use that is not for original purchaser’s personal recreational purposes.

Limited Mechanical Warranty: Armstrong Marine, Inc. warrants to the original purchaser for a period of one hundred twenty (120) days from the date of purchase that the installation performed by Armstrong Marine, Inc. of all mechanical systems and components will be free of defects in installation workmanship.

Limited Exterior Finish Warranty: Armstrong Marine, Inc. warrants to the original purchaser for a period of ninety (90) days from the date of purchase to repair or replace, at its sole option, cosmetic defects including blisters, cracks, crazing, chipping, flaking, and discoloration of the exterior clear coat finish and any paint trim, decals and/or striping.

Before commencement of any warranty work, an Armstrong Marine, Inc. corporate officer must validate any claims in writing and authorize the work to be performed.  Warranty work shall be performed at Armstrong Marine, Inc.’s manufacturing location.  In the event Warranty work is to be completed at a location other than the Seller’s place of business, Purchaser agrees to reimburse seller for transportation charges, lodging, meals, and other expenses and to pay Armstrong Marine, Inc.’s shop rate for travel time and standby time at the agreed rate of $85.00 per hour.

PURCHASER OBLIGATIONS TO RECEIVE BENEFITS

In order for purchaser to receive any benefits of this Limited Warranty:

 

(a) Purchaser must use the vessel for its intended purpose and in the manner suitable to that purpose.

 

(b) Purchaser agrees to perform periodic maintenance as needed.  

 

(c) Purchaser must give Armstrong Marine, Inc. written notice of any claim within the warranty period.  Armstrong Marine, Inc. will not repair any condition or replace any part if a claim is not made in a timely manner.  Transportation expenses and arrangements for warranty work are the sole responsibility of purchaser.

 

WARRANTY EXCEPTIONS

This Limited Warranty Does Not Cover:

 

(a) Any and all accessories, materials, fixtures, furniture, devices, components, and systems not specifically manufactured by Armstrong Marine, Inc., including but not limited to anchors, anodes, batteries, bow rollers, brackets, cables, canvas, carpeting, chains, circuit breakers and panels, cleats, controls, countertops, doors, electrical systems, electronics, engines, fabrics, fans, faucets, fittings, foam, fuses, gauges, hardware, hatches, horns, insulation, lights, locks, metal plating or finishes, motors, paneling, paints,  plastics, plumbing fixtures, pumps, railings, sinks, switches, stoves, upholstery,  wiring, windshields, windows, winches, windlasses, and/or wipers.  These items may or may not be covered by a manufacturer’s warranty.

 

 

(b) Damage caused by misuse, abuse, carelessness, accident, galvanic corrosion, oxidation or electrolysis caused by reverse polarity, negligence, tampering, and/or lack of proper maintenance.

 

(c) Any vessel used for racing or stunts.

 

(d) Any vessel operated contrary to any instructions furnished by Armstrong Marine, Inc., or operated in violation of any governmental laws, rules, or regulations.

 

(e) Alterations or damages resulting from alterations made to the vessel.

 

(f) Damage caused by trailers, supports, cradles, or other transport vehicle(s) on or over land or water.

 

(g) Loss of time, rental charges, vessel payments, travel expenses, loss of use, haul outs, launchings, towing and storage charges, or loss of or damage to personal property.

 

(h) Any vessel that has been powered beyond Armstrong Marine, Inc.’s recommendations.

 

(i) Any vessel that has been overloaded beyond the weight capacity specified on the vessel’s capacity plate.

 

(j) Routine and periodic maintenance.

 

GENERAL PROVISIONS

ALL GENERAL, SPECIAL, INDIRECT, INCIDENTAL, AND/OR CONSEQUENTIAL DAMAGES ARE EXCLUDED FROM THIS LIMITED WARRANTY.  Purchaser's sole remedy for defects in material or workmanship is as set forth herein and no other legal or equitable remedies shall be available to purchaser.

THIS IS A LIMITED WARRANTY. ARMSTRONG MARINE, INC. MAKES NO WARRANTY OTHER THAN CONTAINED HEREIN.  ARMSTRONG MARINE, INC.’S OBLIGATIONS ARE SPECIFICALLY SET FORTH HEREIN AND ARE LIMITED TO THE APPLICABLE PERIOD OF THIS WRITTEN LIMITED WARRANTY AND DO NOT EXTEND BEYOND THE LIMITED WARRANTY.  ARMSTRONG MARINE, INC. SHALL IN NO WAY BE RESPONSIBLE FOR ANY REPAIRS PERFORMED BY ANY PERSON OR REPAIR FACILITY OTHER THAN ARMSTRONG MARINE, INC.

Note: This Limited Warranty gives specific legal rights, and a purchaser may also have other rights that vary from state to state. Armstrong Marine, Inc.’s obligation with respect to this Limited Warranty is limited to making repairs to or replacing the defective parts or corrective installation as outlined above, and no claim for breach of warranty shall be cause for cancellation or rescinding of the contract of sale for any vessel manufactured by Armstrong Marine, Inc.

Armstrong Marine, Inc. will discharge its obligations under this Limited Warranty as rapidly as possible, but cannot guarantee any specific completion date due to the different nature of claims that may be made and services that may be required.

Armstrong Marine, Inc. reserves the right to change or improve the design of its vessels without obligation to modify any vessel previously manufactured.
